GENERAL TERMS AND CONDITIONS

 
  1. DelSuites agrees to provide accommodations to The Guest, including high-speed internet, cable and local telephone service.
  2. The Guest agrees to use the suite as a residential premise and for no other purpose and to abide by the rules and regulations of this agreement and of the condominium corporation.
  3. The Guest agrees not to allow the suite to be occupied overnight by anyone other than the persons registered to the reservation, unless DelSuites has been advised and has authorized use of the suite by another person.
  4. The Guest agrees to arrive no earlier than the arrival time, and depart no later than the departure time, as indicated on the reservation confirmation. Requests for an early arrival or late departure time must be made with advance notice to DelSuites and charges to The Guest may apply.
  5. Written inspections of the condition of the suite are conducted immediately before arrival and immediately upon departure. The Guest understands and agrees that DelSuites shall be entitled to charge for damages not considered normal wear and tear either during the term of the reservation, or upon final inspection of the suite at the end of the reservation. DelSuites agrees to make every effort to repair any damages with the least possible charge to The Guest. Said damages shall include, but not be limited to:
    1. damages to tile or broadloom;
    2. damage to appliances, plumbing and/or electrical fixtures;
    3. damage to doors, walls, ceilings, windows, baseboards or floors;
    4. charge for extra cleaning of suite due to excessive debris left by The Guest on departure;
    5. charge for any kitchen or bathroom damages (chips, burns, scratches, etc. on countertops/vanity);
    6. charge for any damage to parking space including oil stains;
    7. damage to furniture or apartment contents beyond normal wear and tear;
    8. lost revenue where repairs or extra cleaning due to excessive damage/debris/odor resulting in inability to resell suite (pets, smoking etc.);
    9. cost of replacement of lost, damaged or not returned keys, access cards, fobs or remotes, parking decals, including change of suite lock if necessary;
    10. cost of replacing furniture, electronics or contents removed from the suite upon departure.
  6. DelSuites may enter the premises at any reasonable time to complete housekeeping, suite inspections, or maintenance activity.
  7. DelSuites cannot guarantee storage space for The Guest's furniture or bicycles or other large items. Storage of bicycles is not allowed in automobile parking spaces. The Guest agrees to make alternate arrangements for the storage of such items if necessary.
  8. The Guest further agrees:
    1. to return all keys, passes and garage entries of the premises on day of check out;
    2. not to do or permit anything to be done or omitted to be done in the suite, or bring or keep anything therein which may in anyway create a risk of fire or other damage to the premises or cause an increase or premiums of insurance on the building or contents;
    3. not to cause or permit any noise or interference which in the opinion of DelSuites is disturbing to the comfort of other building residents;
    4. not to allow any pets to occupy or visit the premises, including the balcony, terrace or common areas of the property, unless agreed to in writing by DelSuites.
  9. The Guest will agree to provide payment for the following: accommodations as reserved (payment for the first 30 nights will be charged 14 days prior to arrival, or upon booking if the arrival date is within 14 days, and the balance of each 30-night billing period thereafter is due 7 days prior to the first day of it); any and all damages as described above; any long distance, pay-per-use telephone or additional television charges (a 30% administrative fee will apply when such services are ordered through DelSuites); cancellation charges; charges for extra items ordered by The Guest; early arrival or late departure charges; and charges for extension of stay beyond the original reserved dates. DelSuites agrees to provide a detailed description of all charges. The following payment methods are accepted (subject to change at any time without notice): credit card payments (a 2.5% processing fee will apply to credit card payments as of July 1, 2024), pre-authorized debit (Canadian banks only), Interac e-Transfers (Canadian banks only), electronic funds transfers (EFTs), and certified cheques. The original payment method will be automatically used for all future payments unless an alternative has been agreed to by DelSuites. Either a credit card or security deposit is required to be kept on file for the duration of the reservation, and could be used for the purpose of incidental and damage charges.
  10. DelSuites and The Guest agree that neither, by their own acts or those of their families, servants, guests or agents, will they do anything upon the premises which is objectionable or which might injure the reputation of the premises.
  11. The minimum stay is 30 nights. After the first 30-night period, should The Guest wish to depart earlier than the last agreed to departure date, they will give 14 days’ notice to DelSuites in writing to avoid penalty. Should The Guest wish to cancel the reservation prior to the arrival date, they will give 14 days’ notice to DelSuites in writing to avoid a cancellation penalty of $500 plus HST. If The Guest extends their departure date, provided DelSuites is able to accommodate the extension and agrees to the extension, all terms and conditions originally agreed to by The Guest still apply, with the exception that DelSuites reserves the right to amend the nightly rate for the extension period. Extensions requests are not guaranteed.
  12. DelSuites' contents and liability insurance policy does not insure The Guest's personal belongings. The Guest's own home insurance would apply, or if The Guest does not presently have home insurance, DelSuites suggests they arrange temporary coverage through a preferred insurance company.
  13. DelSuites shall not in any event whatsoever be liable or responsible in any way for: :
    1. Any personal injury or death that may be suffered or sustained by The Guest or any employee of The Guest or any member of The Guest’s family, their agents or guests, or any other person who may be upon the rented premises or the premises of DelSuites; or
    2. Any loss of or damage or injury to any property including cars and contents thereof belonging to The Guest or any member of The Guest’s family or to any person while such property is on the rented premises or on the premises of DelSuites.
  14. All furniture is used at The Guest's risk. The Guest understands that there exist certain risks of injury from the use or misuse of such items, including the potential risk of serious injury, disability or death from the use of such items. In addition, The Guest assumes all responsibility for rented furniture while in The Guest's possession. The Guest agrees to indemnify and hold harmless DelSuites owners, operators, agents, and employees from any claim arising from The Guest's use, operation or possession of the rented furniture. Under no circumstances will DelSuites be held responsible for any damage to persons or property, disability, injury or loss, including death, arising from the use of any rented furniture or the failure of the furniture to function as intended by the manufacturer. The Guest has read, agrees and understands this release of liability and fully understands its terms.
  15. All suites under DelSuites management are smoke-free, and this applies to all areas of the suite. There will be a $1000 fee charged to The Guest upon departure if smoking occurs in a DelSuites suite.
  16. The parties intend and agree that the Residential Tenancies Act of 2020 (herein referred to as the “Residential Tenancies Act”) does not apply with respect to the relation between the parties because of the exemption set out in section 5(a) of the Residential Tenancies Act. The rights granted to The Guest are governed under the Inkeepers Act and will not, under any circumstances, constitute a lease or tenancy agreement between the parties. The parties agree that the Tenant Protection Act does not apply with respect to the occupancy of The Guest in DelSuites as the parties agree that section 5(a) of the Residential Tenancies Act provides an exemption.
  17. This agreement may not be assigned, either in whole or in part, by The Guest.
